California Consumer Privacy Statement and California Transparency

Effective date: October 26, 2026

This California Consumer Privacy Statement supplements the Motion Fluid Power Privacy Policy and applies to residents of the State of California ("consumers" or "you"). It is provided under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and its implementing regulations (together, the "CCPA"). Terms defined in the CCPA have the same meaning when used here. The second part of this page contains our disclosures under the California Transparency in Supply Chains Act of 2010.

Part A: California Consumer Privacy Statement

1. Personal information we collect

In the last 12 months, we have collected the following categories of personal information, which we also describe as a notice at collection:

  • Identifiers, such as your name, company, email address, phone number, postal, shipping or billing address and IP address.
  • Customer records described in California Civil Code § 1798.80(e), such as contact details and, when you place an order, billing and payment-related information (card payments are handled by our payment processors).
  • Commercial information, such as products and part numbers you inquire about, quotes, orders, purchase history and shipping details.
  • Internet or other electronic network activity, such as browser type, device type, referring page, pages viewed and the date and time of your visit.
  • Approximate geolocation derived from your IP address (not precise geolocation).
  • Professional or employment-related information, such as your job title and employer.
  • Other information you choose to send, such as drawings, specifications and the contents of your messages.

We do not collect sensitive personal information as defined by the CCPA, other than account or payment details needed to complete a transaction you request, and we do not use or disclose sensitive personal information to infer characteristics about you.

2. Sources of personal information

We collect personal information directly from you (for example, when you email us or request a quote), automatically from your browser or device when you use motionfluidpower.com, and from manufacturers, distributors, carriers and service providers that help us quote, ship and support the products you request.

3. Why we collect and use personal information

  • To respond to inquiries, prepare quotes and provide technical product information
  • To process, ship, invoice and support orders, including warranty and return requests
  • To communicate with you about products, availability and orders
  • To operate, maintain, secure and improve the website, and to detect and prevent fraud or misuse
  • To comply with legal, tax and accounting obligations and to enforce our terms

4. How we disclose personal information

In the last 12 months, we have disclosed the categories of personal information listed above for business purposes to the following categories of recipients: manufacturers and distributors of the products you request (such as TSLOTS, MLS Lanny and Shako); service providers that host our website, provide email and support our business operations; shipping carriers; payment processors; professional advisers such as accountants and attorneys; and government authorities when required by law.

5. No sale or sharing of personal information

We do not sell personal information and we do not share personal information for cross-context behavioral advertising, and we have not done so in the last 12 months. We have no actual knowledge of selling or sharing the personal information of consumers under 16 years of age. Because we do not sell or share personal information, we do not offer a "Do Not Sell or Share My Personal Information" link. If your browser sends an opt-out preference signal such as Global Privacy Control, we treat it as a valid request to opt out of sale and sharing.

6. How long we keep personal information

We keep each category of personal information only as long as reasonably necessary for the purposes described above. Inquiry and quote records are generally kept for as long as needed to serve you and follow up on your request; order, invoice and tax records are kept for the period required by applicable tax and accounting laws (typically up to seven years); and website log data is kept for a short period for security and troubleshooting. We then delete or de-identify the information.

7. Your California privacy rights

Subject to certain exceptions, as a California resident you have the right to:

  • Know and access the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collecting it, and the categories of third parties to whom we disclose it
  • Delete personal information we have collected from you
  • Correct inaccurate personal information we maintain about you
  • Opt out of the sale or sharing of personal information (we do not sell or share it)
  • Limit the use and disclosure of sensitive personal information (we do not use it for purposes that would give rise to this right)
  • Non-discrimination: we will not deny you goods or services, charge you different prices or provide a different level of quality because you exercised your rights

8. How to submit a request

To exercise your rights, email info@motionfluidpower.com with the subject line "California Privacy Request" and tell us which right you wish to exercise. To protect your information, we will verify your identity by matching the information you provide (such as your name, email address and company) with information we already have, and we may ask for additional details. We will confirm receipt of your request within 10 business days and respond within 45 calendar days. If we need more time (up to an additional 45 days), we will tell you why.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require the agent to provide signed written permission from you and may ask you to verify your identity directly with us, unless the agent holds a valid power of attorney under California Probate Code §§ 4121 to 4130.

9. California "Shine the Light"

California Civil Code § 1798.83 allows California residents to request information about the disclosure of personal information to third parties for their own direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

Part B: California Transparency in Supply Chains Act

The California Transparency in Supply Chains Act of 2010 (California Civil Code § 1714.43) requires certain retail sellers and manufacturers doing business in California to disclose their efforts to eradicate slavery and human trafficking from their direct supply chains for tangible goods offered for sale. Motion Fluid Power is committed to conducting business ethically and lawfully, and we do not tolerate forced labor, slavery, human trafficking or child labor in our business or supply chain.

Motion Fluid Power is a distributor. The products we sell, including TSLOTS aluminum framing, MLS Lanny pneumatic valves and Shako stainless steel FRL units, are manufactured by established third-party manufacturers. Our efforts include:

  • Verification. We evaluate manufacturers and suppliers before we carry their products, including their reputation, business practices and compliance with applicable laws. We do not currently use a third party to verify supply chains for risks of slavery and human trafficking.
  • Audits. We do not currently conduct independent or unannounced audits of suppliers. We review supplier relationships on an ongoing basis and may end a relationship where we learn of a violation of our standards.
  • Certification. We expect our direct suppliers to comply with all applicable laws regarding slavery and human trafficking in the countries in which they do business, including laws on labor, wages, working hours and working conditions.
  • Internal accountability. Our employees and contractors are expected to act ethically and in compliance with the law. Failure to meet these standards may result in corrective action, up to and including termination of employment or of the business relationship.
  • Training. Employees with responsibility for purchasing and supplier relationships are made aware of these standards and of the risks of slavery and human trafficking in supply chains.

We review this statement at least once every 12 months and may update it from time to time. The updated version will be posted on this page with a new effective date.
